Click here for complete information.The US Court of Appeals for the First Circuit in Boston, in a 2-1 decision, upheld the constitutionality of New Hampshire's first-in-the-nation prescription privacy law.
- The November 18, 2008 decision overturned the April 2007, ruling by US District Court Judge Paul Barbadoro, who said the law unconstitutionally infringed on free speech. The appeals court said the NH law does not violate the First Amendment and that “…the Act directly advances its interest in containing the cost of prescription drugs…” The 148 pag decision also said, “…New Hampshire has acted with as much forethought and precision as the circumstances permit and the Constitution demands.”
